Prosecutors argued that the motive for the killing was rooted in gang retaliation. On September 7, 1996, a confrontation occurred at the MGM Grand casino in Las Vegas when members of Shakur’s entourage beat Davis’s nephew, Orlando “Baby Lane” Anderson. This act of disrespect, according to the prosecution, could not stand.
During closing arguments, Chief Deputy District Attorney Binu Palal painted a clear picture for the jury, stating, “Duane Davis, in the culture of gangs, could not let that stand. So what did he do? He acquired a firearm, got his group together and went hunting for Mr. Shakur”.
Shakur was in Las Vegas to watch a Mike Tyson heavyweight fight. Just hours after the casino altercation, a white Cadillac pulled up alongside the BMW in which Shakur and Death Row Records co-founder Marion “Suge” Knight were riding.Â
Davis was accused of handing a firearm to someone in the back seat of the Cadillac and ordering them to shoot, a command that led to Shakur being struck multiple times. He died six days later from his injuries.
The Unusual Evidence: A Memoir and a Confession
The case against Davis was built on a highly unusual piece of evidence: his own words. The investigation into Shakur’s murder had been cold for decades until Davis published his memoirs, Compton Street Legend, in 2019. In the book, and in multiple interviews over the years, Davis boasted about his involvement in the killing, placing himself in the car used in the drive-by.
Prosecutors argued that Davis was not just a witness but the orchestrator. Although Davis later pleaded not guilty, the prosecution played clips from his various confessions during closing arguments, using his own admissions as the cornerstone of their case. Prosecutors argued he was “profiting off a murder” by selling his story.
The Defense’s Counterarguments
The defense, led by attorney Michael Sanft, argued that Davis’s accounts were unreliable. Sanft characterized the memoir and public statements as “fiction, not fact,” claiming they were exaggerated and embellished to profit from the enduring fascination with the case.
He also pointed to the lack of physical evidence like DNA or a murder weapon, and argued that the case was tainted by police corruption and mismanagement. Despite the defense’s efforts, the jury found the prosecution’s argument—that Davis himself confessed to the crime numerous times, to be overwhelming.
