Ken Ofori-Atta Sues Ghana’s Special Prosecutor For Declaring Him “Wanted”

Mr. Ken Ofori-Atta, the former finance minister, has sued Kissi Agyebeng, the head of the Office of the Special Prosecutor (OSP), alleging that they illegally declared him wanted.

On Thursday, March 13, 2025, the complaint was filed at the Accra High Court, seeking restitution and a ruling that the OSP’s conduct violated his fundamental human rights.

Given that his information is allegedly still published on the OSP’s website as a wanted person, Ofori-Atta’s legal team contends that the public announcement has caused him undue stress and serious, irreversible injury to his reputation.

On February 12, 2025, the OSP declared Mr. Ofori-Atta a fugitive from justice due to his “noncompliance with invitations to be questioned over ongoing corruption investigations”.

But according to Mr. Ofori-Atta’s attorneys, the ruling was arbitrary and unfair.

Additionally, they argue that their client, a well-known investment banker and former minister, was coping with significant health issues, such as getting ready for a major medical treatment, and had not purposefully avoided the OSP.

His legal team maintains that before the declaration, the OSP was explicitly informed of these health concerns.

Despite the OSP’s announcement on February 18, 2025, that it had taken Mr. Ofori-Atta’s name off the wanted list after receiving guarantees that he would return to Ghana, his attorneys are not happy.

Mr. Ofori-Atta is requesting the court to declare that the actions of the Special Prosecutor violated his rights to administrative justice, fair treatment, and dignity. Additionally, he is requesting damages for the harm the OSP’s announcement caused.
