Maternal Family Sues to Control Funeral and Foundation Account

Another dramatic legal battle has erupted over the funeral arrangements and estate of late Ghanaian music legend, Charles Kwadwo Fosu, famously known as Daddy Lumba.

 

This time, five individuals claiming to be his immediate maternal family have rushed to the High Court in Accra, seeking urgent orders to control his remains and financial assets.

This follows the end to the earlier court case involving the widowhood right between Akosua Serwa and Odo Broni

Plaintiffs Seek Immediate Court Order on Body

Primarily, the plaintiffs are seeking a crucial injunction. Specifically, they have petitioned the court to bar the Transitions Funeral Home in Haatso from releasing Daddy Lumba’s body to anyone without their explicit knowledge and consent.

This legal move, detailed in a writ dated December 3, directly challenges the authority of other parties involved in the funeral planning.

The plaintiffs in this Daddy Lumba family court case are Obaapanyin Afia Adomah Pakoso, Rober Gyamfi (alias Wofa Yaw Poku Asuafua), Georgina Gyamfi, Ernestina Fosuh, and Nana Afia Kobi Pakoso, all from Kumasi.

Request to Freeze Foundation Bank Account

Furthermore, the lawsuit targets financial control. The plaintiffs have additionally requested the court to freeze the Daddy Lumba Memorial Foundation account at CAL Bank.

They are seeking an order to restrain the first defendant, Kofi Owusu Abuakwa, and any members of a previously dissolved committee from accessing account number 1400009943457.

Moreover, they demand a full account and refund of any funds withdrawn from this foundation account after the committee’s dissolution.

Legal Action Against Bank and Funeral Home

The defendants named in this sweeping suit include Kofi Owusu Abuakwa of Kumasi, CAL Bank Headquarters, and the Transitions Funeral Home.

In addition to freezing the account, the plaintiffs want the court to order CAL Bank to remove existing signatories from the Daddy Lumba foundation account.

Subsequently, they propose the signatures be replaced with those of a new committee appointed by the family head.

They seek a perpetual injunction to prevent the defendants from any involvement in the final funeral rites of the music icon.

Urgent Legal Move Days Before Scheduled Burial

This legal action introduces significant uncertainty into the planned funeral proceedings. Meanwhile, the late highlife icon was scheduled to be buried on Saturday, December 13.
